1. Agreement to Terms

By engaging Cut Away Lawn Maintenance ("Company," "we," "us," or "our") to provide lawn care services, you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Cut Away Lawn Maintenance provides professional lawn care and maintenance services including, but not limited to:

Grass cutting and lawn mowing
Garden maintenance and mulching
Fertilization and pesticide application
Aeration and dethatching
Grub control and weed management
Spring and fall cleanups

Specific services, frequency, and pricing will be agreed upon in writing or verbally before work begins. Any additional services requested will be quoted separately.

3. Service Area

We primarily serve Greely, Manotick, Nepean, and surrounding areas in the Ottawa region of Ontario, Canada. Service availability outside these areas is subject to our discretion and may incur additional charges.

4. Scheduling and Access

Services are typically scheduled on a weekly or bi-weekly basis during the growing season. You agree to provide reasonable access to your property for our team to perform the agreed-upon services. If access is not available at the scheduled time, we will attempt to reschedule, but a service visit may still be charged if proper notice was not provided.

5. Weather Conditions

Lawn care services are weather-dependent. In the event of inclement weather (rain, storms, extreme heat, etc.), we reserve the right to reschedule services to the next available day. We will make reasonable efforts to complete all scheduled services within the service week.

6. Payment Terms

Payment terms are as follows:

Invoices are issued monthly or as agreed upon
Payment is due within 15 days of invoice date
Accepted payment methods include cash, cheque, e-transfer, or credit card
Late payments may be subject to a service charge
Accounts more than 30 days overdue may result in suspension of services

7. Cancellation Policy

Either party may cancel ongoing services with 7 days written notice. For seasonal contracts, early termination may be subject to a cancellation fee. One-time services may be cancelled up to 24 hours before the scheduled appointment without charge.

8. Property Damage and Liability

We take great care in performing our services. However, we are not responsible for damage to underground utilities, sprinkler systems, or other items not clearly visible or previously disclosed. Please inform us of any known hazards, underground systems, or special considerations before service begins. We carry liability insurance for our operations.

9. Customer Responsibilities

You agree to:

Remove or secure pets during scheduled service times
Clear the lawn of toys, furniture, and debris before service
Inform us of any changes to property conditions or hazards
Provide access to water if irrigation services are included
Communicate any concerns or special requests in a timely manner

10. Satisfaction Guarantee

Your satisfaction is important to us. If you are not satisfied with any service, please contact us within 48 hours and we will address your concerns promptly. We stand behind our work and will make reasonable efforts to resolve any issues.

11. Limitation of Liability

To the maximum extent permitted by law, Cut Away Lawn Maintenance shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services. Our total liability for any claims arising from our services shall not exceed the amount paid for the specific service in question.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after any changes constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
